DEBTORS
Cleaver Property Management, in collecting debts, treads a careful line between actively pursuing debtors and offering a sympathetic 'ear' to the debtor.
With all debts, each case has to be viewed individually. In this way the Directors can liaise with the Managing Agents to review each debtor and agree a course of action. Cleaver Property Management has a set procedure for dealing with arrears:
1. Invoice date + 28 days
Cleaver Property Management issues a statement
2. Invoice date + 42 days
Cleaver Property Management issues Debtor 1 letter - a request for the debtor to contact Cleaver Property Management to discuss the debt and arrangements to clear arrears.
3. Invoice date + 56 days
Cleaver Property Management issues Debtor 2 letter - informing the debtor that Solicitors have been instructed and that arrears and costs will be recovered. The file is passed to the Solicitor and action taken immediately. This includes informing the mortgagor.
Cleaver Property Management will in all cases listen to the debtor and any arrangements to pay including liaison with DSS etc. Cleaver Property Management however, must satisfy itself that the scheme is going to reduce the debt over an acceptable period and that the debt is going to be recovered. Cleaver Property Management has a duty to the Management Company to analyse each debt and make a judgement on whether there is a realistic chance of the debt being realised Equally the Auditors will require to know what action is being taken on debtors and the chance of recovery.
Cleaver Property Management will however, use the full weight of the law and the terms under the lease to recover any debt it feels has little chance of being recovered.
